COLLECTING DEBTS
Many people are amazed at the difficulty of collecting a debt, even when the debtor does not contest the debt. Court costs and legal fees can be spent to obtain a legal judgment at court, only to have the judgment go unpaid.
Whether you are professional or other business collecting a bill for services, a lender collecting a consumer debt or foreclosing on real property, or an individual with a substantial debt that seems uncollectible, I am willing to discuss your collection matter without charge, and without an obligation. I do not have a volume practice and do not collect large portfolios of small debts. I pay close attention to every collection and communicate with my clients as much as they desire.
Unfortunately, for most collections, no guarantees can be made. Many difficulties may arise. A debtor may declare bankruptcy and avoid paying most debts. In the few cases where a debt may not be dischargeable in bankruptcy, I can represent my clients in bankruptcy court when warranted.
Many creditors are alarmed to learn that they cannot obtain their legal fees expended on collection efforts, unless a written agreement with the debtor allows this type of recovery. I can also work with clients to learn from past mistakes and organize their contracts so that the client will have the best possible chance of collecting any future debts.
A debtor may be difficult to locate, or may have few resources with which to pay the debt. I can provide my client with an honest assessment of the most cost-effective way to obtain payment from a difficult debtor. Unfortunately, some debts simply cannot be collected without incurring legal fees and costs that will exceed the amount owed.
